SeaKing Limited Warranty

SEA-KING(BOAT BUILDERS)LIMITED, trading as SeaKing Boatbuilders (“SeaKing”, “we”, “us” or “our”), builds each SeaKing vessel as a low-volume, hand-finished craft.
This Limited Warranty explains the warranty provided by SeaKing for a new SeaKing vessel. It is designed to give owners confidence in the materials, workmanship and structural integrity of their vessel, while recognising the specialist nature of a high-performance, hand-built boat.

2. What this warranty covers
Subject to the terms of this policy, SeaKing warrants that a new SeaKing vessel will be free from defects in SeaKing’s materials and workmanship at the point of delivery.
During the applicable warranty period, SeaKing will, at its reasonable discretion, repair or replace a part, component or area of the vessel affected by a covered defect.
This warranty covers defects in materials or workmanship relating to SeaKing-designed, SeaKing-built and SeaKing-installed elements of the vessel, including:
hull, deck and superstructure construction;
structural bonding, laminates and composite construction;
cabinetry, fitted furniture, interior joinery and SeaKing-fitted trim;
SeaKing-installed plumbing, electrical and mechanical installations;
SeaKing-installed deck hardware, fittings, seals and finishes;
paintwork, lacquered timberwork and cosmetic finishes where there is a demonstrable defect in SeaKing workmanship or application.
3. Warranty periods
Comprehensive SeaKing Warranty
SeaKing provides a 24-month limited warranty from the documented handover date of the vessel.
This covers SeaKing-supplied materials and SeaKing workmanship, subject to the exclusions and conditions in this policy.
Structural Hull and Deck Warranty
SeaKing provides a 5-year limited structural warranty from the documented handover date of the vessel.
This applies only to a defect in SeaKing-built hull, deck or structural composite construction which results in a material loss of structural integrity.
The structural warranty does not cover cosmetic finishes, paint, varnish, gelcoat, timber movement, fittings, equipment, ordinary deterioration or damage caused by external events, misuse or inadequate maintenance.
Replacement parts and repairs
A replacement part or repair does not restart or extend the original warranty period.
Any manufacturer warranty supplied with a replacement component may apply separately.
4. SeaKing’s remedy
Where SeaKing accepts a valid warranty claim, SeaKing may, at its discretion:
repair the affected area or component;
replace the affected component with a new, repaired or remanufactured equivalent;
arrange repair through a SeaKing-approved marine specialist;
carry out the work at the SeaKing facility, an approved service location or another location agreed by SeaKing.
SeaKing will use reasonable efforts to complete approved warranty work within a reasonable time, taking account of the nature of the defect, vessel location, access, weather, parts availability, safety considerations and the complexity of the work.
SeaKing may inspect, test, photograph, remove or retain parts in order to determine the cause of a claimed defect.
5. What SeaKing does not cover
This Limited Warranty does not cover:
normal wear, ageing, use, deterioration or routine maintenance;
consumable items, including fluids, filters, lubricants, belts, hoses, impellers, anodes, fuses, batteries and similar service items;
cleaning, polishing, anti-fouling, winterisation, storage, lifting, launching, berthing or routine servicing;
ordinary cosmetic ageing, including minor marks, scratches, scuffs, fading, staining, patina, weathering or UV-related change;
natural variation in timber grain, colour, figure, tone, movement or finish;
natural variation in leather, upholstery, hand-finished trim, stone, metal, lacquer, paint or other crafted materials;
minor surface irregularities which do not materially affect appearance, safety, function or structural integrity;
corrosion, galvanic corrosion, electrolysis, osmosis, fouling, water staining or deterioration caused by environmental exposure, inadequate maintenance, incorrect storage, contaminated water, incorrect shore-power connection or failure to maintain protective systems;
damage caused by collision, grounding, impact, fire, theft, vandalism, storm, flooding, immersion, towing, transport, lifting, launching, recovery or other external events;
damage caused by accident, misuse, negligence, abuse, overloading, incorrect operation or use outside the vessel’s documented limits;
use for racing, commercial charter, hire, training, demonstration, towing or other commercial purposes unless expressly agreed in writing by SeaKing;
failure to follow SeaKing’s written instructions, owner documentation, safety guidance, maintenance requirements or the instructions of a component manufacturer;
alterations, modifications, repairs, installations or removal of equipment not approved by SeaKing where those actions caused or contributed to the claimed defect;
damage caused by non-genuine, unsuitable or incorrectly installed replacement parts, accessories or equipment;
faults caused by poor workmanship of a third party not appointed or approved by SeaKing;
a condition disclosed before delivery, recorded at handover, agreed as part of the vessel specification or accepted as an inherent characteristic of the vessel;
performance variation caused by weather, water conditions, load, fuel, passenger numbers, propeller selection, maintenance condition, vessel trim or other operational factors.
Performance figures, speed estimates, range estimates, illustrations, drawings and visual representations are indicative unless expressly incorporated into the signed purchase agreement or vessel specification.
6. Third-party equipment and manufacturer warranties
Certain components fitted to a SeaKing vessel are manufactured by specialist third parties.
These may include propulsion equipment, engines, gearboxes, controls, batteries, charging systems, navigation equipment, audio equipment, communications equipment, trailers, safety equipment and accessories.
Where fitted, these components may be subject to their own manufacturer warranty, including, for example, a Mercury Marine warranty for Mercury propulsion equipment.
SeaKing’s Limited Warranty covers defects in SeaKing’s installation of third-party equipment. It does not replace, extend or alter the separate warranty given by the component manufacturer.
SeaKing will reasonably assist an owner in making a claim under an applicable manufacturer warranty where the equipment was supplied by SeaKing, but SeaKing is not responsible for a manufacturer’s decision, delay, refusal or separate warranty terms.
Nothing in this section limits any rights you may have against SeaKing under your purchase agreement or applicable law.
7. Owner responsibilities
To maintain warranty cover, the owner must:
operate the vessel safely, responsibly and within its documented limits;
follow SeaKing’s written care, maintenance, servicing and winterisation guidance;
follow the maintenance requirements of third-party component manufacturers;
arrange appropriate maintenance through suitably qualified marine professionals;
protect the vessel from avoidable deterioration, damage or water ingress;
stop using the vessel where continued use could cause further damage or create a safety risk;
keep reasonable maintenance, servicing and repair records;
notify SeaKing promptly of a suspected defect.
Failure to comply with these responsibilities will affect warranty cover only to the extent that the failure caused, contributed to or materially increased the claimed defect or prevented SeaKing from properly investigating it.
8. Making a warranty claim
A warranty claim should be made as soon as reasonably practicable after a defect is discovered.
Please contact SeaKing before arranging repair work, except where immediate action is reasonably necessary to protect people, the vessel or other property.
Submit claims to:

the vessel hull identification number;
the owner’s name and contact details;
the delivery or handover date;
a clear description of the issue;
photographs or video where practical;
the vessel’s current location;
relevant service, maintenance or repair records;
details of any emergency action already taken.
SeaKing may ask to inspect the vessel before authorising repair work.
Where emergency repair is necessary, the owner should take reasonable steps to limit further loss or damage, retain any removed parts where practical, keep invoices and evidence, and notify SeaKing as soon as possible.
SeaKing is not responsible for unauthorised repair costs, except to the extent that emergency work was reasonably necessary and SeaKing would otherwise have been responsible for the defect under this warranty or applicable law.
9. Transport, travel and associated costs
For an accepted warranty claim, SeaKing will meet the reasonable cost of the approved repair work, including parts and labour.
SeaKing must approve in writing any travel, recovery, lifting, transportation, craneage, berthing, accommodation, surveyor, haul-out or third-party service costs before they are incurred.
SeaKing may decide whether the vessel should be repaired at the SeaKing facility, by an approved specialist or at another agreed location.
This warranty does not cover loss of use, loss of enjoyment, loss of charter income, loss of business, substitute-vessel costs, travel costs, accommodation costs, mooring costs or other indirect or consequential losses, except where SeaKing is legally required to meet them.
10. Transfer of warranty
The balance of this Limited Warranty may be transferred once to a subsequent owner of the vessel, provided that:
SeaKing is notified in writing within 30 days of the transfer;
the new owner provides evidence of ownership and contact details;
the vessel has been properly maintained;
SeaKing receives relevant maintenance and service records;
SeaKing has not identified an unresolved breach of this policy.
A transfer does not extend the original warranty period.
SeaKing may reasonably require an inspection before confirming a transfer of the remaining warranty. Any inspection cost will be agreed in advance.
This transfer provision does not affect any statutory rights held by a purchaser against the party that sold the vessel to them.
11. Statutory rights
This Limited Warranty is provided in addition to, and does not replace, any legal rights you may have.
Where you buy a SeaKing vessel as a consumer, your statutory rights may include rights relating to goods being of satisfactory quality, fit for purpose and as described.
Your statutory rights are against the party that sold you the vessel. Where SeaKing is the selling party, those rights are against SeaKing.
Nothing in this policy excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
12. Business purchasers
Where the purchaser acquires a SeaKing vessel wholly or mainly for business, commercial, charter, hire, trade or professional purposes, the purchase agreement and its warranty provisions will apply.
To the fullest extent permitted by law, SeaKing excludes liability under this Limited Warranty for indirect or consequential loss, loss of profit, loss of revenue, loss of business, loss of opportunity, loss of goodwill, loss of use or loss of charter income.
Nothing in this section limits liability which cannot lawfully be excluded or limited.
13. Governing law
This Limited Warranty is governed by the law of England and Wales.
Any dispute relating to this warranty shall be subject to the courts of England and Wales, except where mandatory consumer-protection law provides otherwise.
14. Changes to this policy
SeaKing may update this policy from time to time for future vessels.
The version provided with your vessel at handover will apply to that vessel unless SeaKing agrees otherwise in writing.
